Can I fight an auto insurance company, to prevent my car from being declared a total loss, in California?

Its an older car but only has a small dent. I understand that its the value of the car vs their estimate of repairs that they are basing this on, but they didn't include options like A/C, cruise control, power door locks and power mirrors and others when figuring its worth. They instead based it on an average car in my area. When doing the math the difference between fixing the dent and totaling the car came out to $18.00. Clearly the addition of the options would have covered that spread in my favor. I want to fight this because I don't want to have a salvage title. I was not at fault and the other parties insurance has already sent me a check I have not cashed nor have I signed anything. I want to know what I can do. And if I am stuck with the total loss, do I have the right to recover for re-title and re-registration charges and smog fees that are going to add up to a few hundred out of my pocket since I am keeping the car. My insurer wants to charge me a lot for canceling my insurance?

My insurance company (Kwik Fit) tell me that if I cancel my insurance today I will have to pay the normal monthly rate tomorrow as I normally would and then the charge of 67 to cover the cancellation. Question about suing car insurance company after auto accident.?

My mother was the passenger in a vehicle that was rear ended on the interstate a few weeks ago. The driver is a co worker of hers. They were both injured but not rushed to hospital. My mother suffered a fractured disc in her back and whiplash. The driver suffered from whiplash and torn ligaments in her neck. They are both still seeing a doctor. They asked me to handle this for them. I am not an attorney, but have sued the insurance company of the driver at fault before (state farm). It was all going ok, i had all paperwork needed and was asking for $9500 each including medical. The claim has been turned over to an impossible woman. She refuses to deal with me and wants to deal directly with mother and coworker. Should I hire an attorney now, and how much should we ask for/get? p.s. both are told by doctor that they will have long term therapy.

I was in a wreck that the insurance company of the other driver agreed to pay for. They made an estimate and said they will put a check in the mail. They said that if it costs more than the estimate, then they will take care of that also as long as I show the estimate to the repairman. That seems straightforward... and on the other hand: With other car issues, auto shops have seemed to be willing to underbid each other. I wouldn't mind getting it fixed for less than the check that I'm going to receive. Should I try to get estimates that are independent of the insurance company's estimate to see if I can save money? If I then go with a shop that says they can do it for cheaper, can I trust that they won't say it will be more later?
